This contract is between My Forever After (hereinafter referred as "The Photographer") and
the Person who has either booked or paid for a photoshoot (hereinafter referred to as "The Client").

This agreement will become binding and effective, once the Client has made a payment and the Booking Confirmation has been sent to the Client.

Payment and Reservation
A non-refundable booking fee or 50% of the official invoice will confirm your booking, as well as full acceptance of the terms and conditions as published on the photographer's website. This fee secures the date, time and services of the Photographer and is not refundable or transferable in the event of cancellation, it being the agreed loss suffered by the Photographer due to cancellation. The booking fee will be deducted from the total of the client's chosen package when calculating the final balance due. Payment of the balance must be paid no later than 1 week (7 days) before the actual wedding day.

On the Wedding Day
1. Exclusive Photographer/Videographer: The Photographer shall be the sole professional Photographer/Videographer of the day at the venue(s) specified. The Photographer will not be held liable for over exposed photos caused by flash or lighting from other cameras/video cameras.

2. Special Requests and Moodboards: The Photographer will honour all photographs requested (such as specific family members, or in front of a specific building, etc.) and agreed in advance, provided the following factors are met: weather and allocated time permitting, availability and co-operation of the person/s concerned.
Please note that we do not work off Pinterest moodboards, as this will steal the allocated time we have with you, and essentially miss those true You moments.

3. Coverage: The Photographer will not be held responsible for the lack of coverage caused by the bride, the groom, or wedding party not being on time, or by any obstructed view caused by a guest, the Church, Officiator, or Licensed place of wedding restrictions on photography. The Photographer does not undertake to guarantee any specific picture nor incorporate any specific background, location or group arrangement. Where restrictions or limitations are set by any official or person possessing the correct legal authority to do so, the Photographer shall not be held responsible for non-fulfilment of this contract.

4. Accommodation & Travel fees and Meals: Should the venue for the function be more than 150 km (or more than 1 hour's drive) from Cape Town, suitable accommodation should be provided for the Photographer and an assistant (if applicable). These accommodation charges are excluded from the quote.
Travel fees are excluded from the Wedding Packages quote and are for the Client's account. This is charged separately on the invoice.

The Client is required to provide meals for the Photographer and assistants (if applicable) during the time when the dinner is being served to the wedding guest. These may be served in the dining room or at another location in the reception venue. It is requested that the Photographer and assistant be seated in the dining room if at all possible so as to be able to continue photography during the meal.

5. Overtime: All overtime charged will be computed at R2000 per hour (or part thereof), or as otherwise agreed between the Photographer and the Client. Should the Photographer feel that most moments have not been covered, the Photographer will discuss this with the Client and will only stay when it has been approved by them or with their consent.

6. Workflow : Client acknowledges that photography on event day is at the sole artistic discretion of the Photographer. Client acknowledges that the Photographer has a specific style, and adheres to the said style. No shots throughout the day are guaranteed (due to so many determining factors on the wedding day). Guests standing in the way (i.e with cellphones) will/may alter services rendered and ultimately miss key photography moments.

7. Weather: Although we create magic on your wedding day with our cameras, we cannot control the weather. All outdoor photoshoot sessions are weather dependent, as our electronic gear will certainly damage in bad weather conditions, such as rain, mist, etc. It remains the discretion of the Photographer to make a decision on where to shoot (alternative location, like indoors), keeping the couple and equipment in mind.
Should the weather not permit for drone footage (packages that include drone footage, or as an upgrade), we will do Guest Messages & Wishes instead.

8. Time required for shoots: Please allocate enough time for your Family, Bridal and Couple shoot on the Day's Program.

> Family photoshoot takes around 10mins (preferably done directly after confetti, as everyone is there in one spot and not drifting off)
> Bridal Party around 20mins.
> Please allocate at least 45min-60min for your Couple photoshoot session.

Product Delivery, Editing and Resubmission of Photos
Photographer agrees to deliver photo previews/video trailers to Client no later than 7 days after the date of the shoot. No edits will be delivered if any fees are outstanding. All edited photos/videos delivered to Client are licensed for Client's personal use only, to use social platforms and printing. The amount of edits will depend on which online wedding package the Client has chosen, with the option to buy extra edits at R30 per photo (edited, JPEGs).
RAW (original, unedited) photos/videos from the shoot are not included in the price for the photography/videography services. Special request for specific photos to be edited must be sent to the Photographer no later than 30 days after the Wedding Date.

Client agrees that all photographs/videos will be edited in the Photographers editing style, as seen on social media such as Instagram/Facebook/Website, and delivered to the Client in the form of an online gallery. The online gallery is sharable with friends and family. The online gallery link will expire 30 days after it has been sent to Client. Editing should take between 4-6 weeks, depending on workload (in season).
Client cannot expect Photographer to edit and deliver photos/video in the another photographer's editing style, i.e. Pinterest, New York Fashion Photographer
All files are kept on our servers for a maximum of 6 months. Should Client want a reissue of photos/videos, an online hosting fee of R1000 will be charged.
Videography: Client is allowed 1 revision (up to 15min of work on project), after which an hourly rate of R2000 per hour or part thereof will be charged.
Cellphone photos: We regrettably do not edit cellphone photos.

Wedding Albums
Client is required to select their favourite 60-70 edits for their wedding album. Clear instructions will be given how to go about choosing favourite edits.
Client will receive a proof (pdf.) version of the album, to see if Client is happy with the layout, ect. After Client has approved the album proof, album is sent off for printing. Wedding albums take around 10 working days to print, then sent to Client via courier (cost included), or personal delivery (if applicable).

Duty of Client
Client will obtain all permissions necessary for Photographer to photograph/film at the location. The Photographer has no duty to obtain permissions at reception centers, churches, buildings, properties, or other location to operate thereon. The Client agrees that any failure to obtain these permissions resulting in fines to the Photographer, or which prevent the Photographer to photograph/film the event(s), is not the fault, liability, or responsibility of the Photographer.

Attendance
In the unlikely event that the Photographer is unable to complete the coverage due to unforseen circumstances,
the Photographer reserves the right to appoint another Photographer (part of his team with the same shooting style) to attend on his behalf and cover the wedding photography.
All photography and videography will still be edited in the Photographer's style/My Forever After style, as seen on his website/social media.

RAW Files
The RAW, unedited files are not included in the wedding package, however, the Client has the option to buy all RAW files captured on the day.
The Client is requested not to tag Photographer/My Forever After in any photos/videos that Photographer/My Forever After did not edit,
as this does not represent our work any longer, and may lead to misleading work for future potential clients.

Client Acknowledgement
The Client hereby accepts the quotation from the Photographer to render and supply all services and materials as agreed upon on these terms and conditions. The Client agreeing to the contract acknowledges that they have read and understood the terms and conditions and agrees to all the above and is further familiar with all details of the selected wedding package.
